Hey Everyone,
I am wondering if EN staff/ evaluators will reject (for lack of a better term) a submission that has been submitted previously by another person. Its hard for me to explain my question by typing it, but here goes……
I am wondering if “John Doe” submitted an idea that had already been submitted by “Jane Doe” (and possibly multiple other people on multiple other occasions) on a previous search(s), and that idea had been rejected by EN on all prior occasions due to existing patents or IP issues…does EN remember those prior submissions and reject John Doe’s submission in the early stages (1,2,3,4) or will they continue it through until the patent or IP issues are brought up yet again in R6???
I know this might be a difficult question to understand, but I guess my main question is….At what point does EN reject “not so original” ideas that they have already reviewed and rejected on prior occasions?……whew that was a little easier…hahahhahaha

This may not be a very helpful answer Daniel, but the honest truth is “it depends”. The fact is, although we may get submissions that are very similar to each other, no two submissions are ever truly identical. During the review process, our team works to understand the unique elements of each submission. If a similar submission has been rejected in the past based on an existing competitive product or perhaps an existing issued patent that might make commercialization difficult, that certainly is something our review team considers. On the other hand, we keep an open mind with every submission. Just because a prior similar submission might have been knocked out doesn’t necessarily mean all future similar submissions will be rejected.
So to answer your question as directly as possible using your example, it is likely that John Doe’s submission, assuming it otherwise meets the criteria to pass the early stages, would continue through the review process so that it could be independently evaluated on its own merits. It is not likely it would be automatically rejected simply because it is similar to one or more previous submissions, however the review team will take such factors into account.
