America Invents Act is now law...Thanks Louis!

Wow, our own Louis Foreman was on stage for the signing of this major legislation that will affect all of us. We are fortunate to be part of an organization (EN) whose creator is such an advocate for us independent inventors. Do you guys have thoughts on this major change in our patent system?

AFAIK, Mr. Foreman is the first person to serve two consecutive terms on the PPAC. They selected the best man for the job (twice)!

Wow, this must have been a lifetime experience for Louis. I was in support of this and it’s good to see that it was championed by Louis and finally passed. BTW – Tell Louis do not get too comfortable at the White House (or Washington in general).. we need him at EN/EE. :-)

Actually it looks like a pen case on the table ( Blue Box ) there so he might have recieved a POTUS Pen .If you ever
notice in the future The POTUS uses each pen when signing any new law.

Yes this is also true and I also don’t agree with the rest of the worlds price restrictions myself but a patent is a patent and it does expire and that’s where generic drugs comes into play.The thing is this one drug company gets this deal and no other drug company….It smells !

Yes this isn’t the place to discuss this further and will let it go.

Rainer…I have a lot of thoughts on generic drugs and the length of protection, cost, time, red-tape, liability and our drug companies having to subsidizing the rest of the world’s price restrictions, etc…but I wont get into this now and on these forums.

Yes this is true Eric and expected from Washington sadly enough…but this earmark has REPERCUSSIONS
for everyone who needs drugs and will have to pay the higher price as oppose to the generic drug.

And this powerful lawfirm dosn’t have to pay out $214 million in a malpractice suit ?

What’s going on here is what I want to know .

“The House might have sworn off earmarks, but that didn’t stop the chamber from essentially passing one last week that would allow a single drug company to avoid generic competition while saving a powerful law firm from paying out $214 million in a malpractice suit”

Consider this fee-reduction benefit for independent inventors:
“Among the changes proposed in the America Invents Act, which was passed by the Senate in March and by the House in June of this year, is the creation of a “micro-entity” class that will receive the benefit of a 75% reduction in USPTO fees.

Presently, an applicant having “small entity” status receives a 50% fee reduction with the Patent Office. To qualify as a small entity, the applicant must be an individual inventor, a business having less than 500 employees, or a nonprofit organization or university. To claim the new micro-entity status, an applicant would have to not only qualify under the small entity guidelines, but must further assert: that the applicant has been not named as inventor on more than four previuosly-filed US patent applications; that the applicant’s annual income does not exceed three times the US median income; and that the applications is not assigned or subject to be assigned to an entity having an income over three times the US median income."

On that note I don’t like what happened at the last minute with this earmark for the bill..very disturbing to say the least….And
the person behind it is very surprising and the rest just caved in.

I thought we were done with earmarks !
