someone can reproduce virtually the same invention as yours but as long as their claims do not ‘read over’ your claims they have not infringed

I think Brendan you are talking about a new use type of patent. An example I read about is the medicine aspirin. Supposedly if the drug is given to cattle it causes weight gain. Now a new patent is possible because the application and results are both un-obvious and novel which is key to obtaining a patent. Same product, different claims.

Hi Brendan, don’t know if it helps, but found the new use patent for aspirin and cattle. Check out: http://www.google.com/patents/about?id=ImddAAAA...
The claims are all about aspirin being a growth stimulant which was an unexpected discovery.

Hi Brendan

I wrote my own patent(not fun, took forever) I think dond is right. I read a book called Patent it Yourself by David Pressman and he uses the cattle aspirin example in his book.
