I have an old friend (also aged, now in his mid 80s) who is a great inventor. He has run out of steam to pursue his inventions and ideas commercially so asked me if I would do so on his behalf. I wanted to do this more formally and know there are some standard forms I can use. I wondered if anyone had any first hand experience with this & whether I could make submissions to EN if I had this assignment. I envisage having a schedule of payments as part of the assignment so I won’t take any share of the profit for amounts below $10,000 and on a sliding scale thereafter up to a maximum of 50%.

I don’t know if this will help in deciding the best way to handle profits from sales. I have a licensing agent where we decided on a set percentage. A simple contract showing that my agent receives a percentage of gross sales. In terms of taxes, best to have a contract.

Just got a reply from EN (Quick!). Basically says “Yes you may submit your idea to EN”

I actually had this same question. I own the assignment rights to a patent, but wonder if EN will even have an interest. How would that work? Would they then assign them from me? I’m not the actual inventor. I just own the rights at this point. I don’t know if you can double assign rights.

Hello Mogie,
I am in a similar situation as I and my uncle bang heads and come forth with a submission as a team. I do the listings and our agreement stays between us. That way there’s nothing any other organization has to contend with. I get paid, he gets his half minus the taxes I have to pay and everything works out fine with all parties covered. A simple business agreement will do and hold up in a court.

Jane, I had intended that the payment arrangement be between ourselves ie. if I received payment as “owner” of the IP, I would share with him as per our agreement. I have just thought of something – it may be a bit complicated in the event of some success, would I then be able to assign these rights to EN? I might have to contact the EN team directly when we get this underway.

Mogie, sounds like you’ll need a lawyer to help you set that up. EN isn’t set up to pay more than one inventor.
