Hi all,
I’ve aquired a trademark for the name “Shampoodle”, a very sellable name, for a pet shampoo, a common marketable product. I even created a mock up for it. I really don’t have the funds to get this off the ground but I do think it would be a huge seller.
1. Do I go to the companies that might put it on the shelf and present it to the big wigs.
2. Do I try and find a manufacturer of a similar pet shampoo product in the hopes that he would buy the name and perhaps a percent of the sales.
3. Are there investors out there who would help out someone just starting out? If so, how much will it cost me to get this off the ground? Sincerely, Lisa R. Lee

You are very welcome. The path for most inventors can be treacherous because we don’t know what to ask or whom to ask. However, EN provides tons of valuable information but it does take some digging and a lot of sorting through the comments – which are opinions and which are factual.

You don’t have to have a patent in order to participate in the searches here, but Edison Nation does have the ‘Insider Licensing Program’ for individuals that do have patents. EN does recommend writing a well communicated description of the idea and also ‘suggests’ uploading jpg pictures of your concept and/or a video, I think under 2 minutes long, to also explain the idea. The better communicated, the easier for EN to process.

Hi Lisa,
When you asked, “How do I get the rest of my ideas and inventions out there without it costing an arm and a leg?”, I don’t know if you have looked in detail at the Edison Nation website, but you can look at the searches that are going on currently and see if any match your ideas and inventions then submit them to EN. They have live product searches and innovation fund searches. It doesn’t cost very much and the benefits of seeing an idea get to fruition is a reasonable goal here. I also recommend, if it suits you, to become an ‘insider’ because of the smaller fees involved.

Well, I guess I won’t be going after anyone for having my trademark name. You’re right. I did’nt do my homework. It’s my problem. I was given only a few months to get this done and then the trademark will “dead”. It did’nt cost that much. Really did like the idea though and learned quite a bit. The lesson was worth a great deal to me.

Whether Andre has a trademark for it or not he is selling under that name. Having a Trademark or patent doesn’t matter to people unless you have the backing to go after them and make them stop. If you have the trademark do you plan to go after everyone using your trademark to sell the same type of products?

Sleepyhead, I recon you are correct about other shampoodles being out there in their domains. I just would like to get mine into the stores and since I have the trademark – I’m just trying to get info on how I could get it done if I were ambitious to try.

Your right Roger, it is Shampoodle (Andres’s Shampoodle) I’m not sure if he has a trademark for. I guess my hope is to have my “Shampoodle” in a PetSmart store some day and perhaps Wal-mart.

If not they are already selling Shampoodle shampoo for pets. I am not trying to shoot you down. I am just pointing out that you Trademarked a name and want to use it on a product for pets and it appears someone is already doing that. The reason I pointed out the domain name is that most people want to sell their product online using the same name as the product so it makes it easier for the consumer to find it. Right now if you were selling Shampoodle and I put that product name in Google I would find your competitor and not you.

A shampoo, with the name shampoodle in it, is still a shampoo and several other companies are already using that name for their shampoos. I’m not sure where you are going with this – especially without a domain name.
The companies using the word shampoodle might be offering services but the services are based on shampooing a pet; otherwise, their using that word doesn’t make any sense.

Yes, I do understand everything you all are saying. There are countless names and even domain names out there that are the same. However, I have a shampoo with a specific name and a specific purpose and a specific trademark.
Example: Ford – so if I started a business/ or product called Ford this would not be possible? There are countless companies with the name Ford including the auto company. Perhaps, none of them have a trademark – but they are all able to do business just the same.
I don’t believe I have to own the domain name in order to sell my product to a pet store or manufacturer – but I have to admit this whole invention business is a little unsettling. I have so many ideas for interesting names and item inventions and havent really got any clue how to get them out there without it costing a fortune.

Lisa, Just consider this an expensive lesson learned. Even with the TM, you don’t have a domain name using that word and since there are so many other websites/domain names using shampoodle, (as Roger pointed out), it would cost you a lot of money to go after them to cease and desist using that name. Even then, they might have a case built on length of use. And we know that those with the shampoodle domain names didn’t bother trademarking the name; otherwise, their TMs would have shown up in the search.
Yours is not an uncommon mistake so don’t beat yourself up too much.

There was a Dog Salon about a mile & a half from my house (S.E. Michigan) That was the name on the building… I’m not sure if it’s still there or not.

So I am clear. You are saying you don’t have a product that you are selling under this trademark. You are wanting to find a company that would want to use that name and pay you for the trademark. Before buying the trademark did you bother to see if anyone had purchased the domain name http://www.shampoodle.com/ http://www.shampoodledogwash.com/ http://twitter.com/#!/shampoodle
Most companies that would want to use a trademark also want to be a ble to use it online as a marketing tool. If there are numerous other products or companies using that name it can deter them from wanting the confusion.
