Legal questions about Patents

camel2's Avatar

Are existing patent holders compelled to declare their patents when asked? I want to manufacture certain products but how do I know they are not already under patent?

Hi James!

The Edison Nation team cannot provide legal guidance. We always recommend to direct any legal questions to a patent attorney.

Best of luck!

For starters, you should be doing a patent search. The USPTO has plenty of resources for a situation like this.

James,

Probably the most simple way to start researching exsisting Patents :

https://patents.google.com

Remember you will want to research the last 20 years worth of relavent patents. You would be suprised what you might find. Many people have patents on products/ideas/concepts you have never seen in a store. It's really quite difficult to not find something similar to your idea...
