Good morning EN community -

I just got off a good follow up call with the lead at Worthington and wanted to provide you an update on the presentation. I want to start by sharing a comment that their team lead made in summation of the presentation:

" I want to express how impressed I was with the strategic thinking that went into the ideas that your community members submitted, as you know several of these we have passed on due to being too similar to internal products already in development, so it shows that folks were thinking on the right track, or least we hope they were, since we have these in development"

For some of the items we went through their development pipeline and there were too many similarities and they stated NEXT during the presentation, which is a sponsors code for passing due to similarity/familiarity with on-going development. 

As you have often heard us say, innovation and product development and review is a process, and several EN community members will be going into the Worthington process. We have  two concepts from Bernzomatic and three concepts from Balloon Time that will be going to their next stage. ALL ideas they look at, even internal move into a Scorecard Stage, this happens montly and leaders from their various cross-functional teams all meet once a month and review/grade innovations. Luckily for all of us, the next monthly meeting is slated for NEXT Tueaday, Dec. 5th. The current plan is these 5 concepts will go through Scorecard Stage and we will get update middle of next week on them potentially moving into a Due Diligence phase.

We will be updating dashboards over the next 24 hours and good luck to the 5 innovators/innovations moving into Scorecard Stage and once we have updates next week we will advise.

Yeah Wendy, that is really an accomplishment! This search seemed so technical and narrow that it totally scared me away. I'm amazed that anyone can command their brains to think in that area at all, much less make it all the way to G7.

Three part question .... For the members whose ideas were passed on "due to being too similar to internal products already in development", in this search or any search for that matter, are the members advised in the feedback that similarity to products in development is indeed the reason for the rejection? Also is there any thing in the submission agreement that would keep the person with the submission that went to presentation from filing at least a provisional patent application on their invention after presentation? Also are the companies that are being presented to made aware if there is any patent protection already in place during presentation? It looks like this would be a concern for them. 

With USPTO's first to file rule if you felt like you as a submitter really had a slam dunk filing a PPA could be the best $$$$$ a person might spend even if you as a submitter didn't want to or have the resources to pursue the idea on your own. I realize this wouldn't be a very good advice for the vast majority of ideas being rejected as similar for many reasons but if you had something with a unique twist it might be a safeguard that could result in some compensation in case see your idea on the store shelves at a latter date.The biggest hurdle for most with this strategy is probably the year time limit on the provisional patent application and the cost involved with a utility patent since most products wouldn't come to market within the one year time limit of a provisional patent. I guess you could keep losing the time stamp on the PPA and refiling till you see if your idea appears in the market place.

I can speak to the first part of your question - I was advised in feedback that the primary reason for a "pass" on one of my submissions by the sponsor in the Balloon Time search was a similar innovation already in development, and I assume other finalists received similar feedback when applicable.

Archie - Robert handled one part, and I can advise on the other two. There is nothing within submission agreement that would keep an innovator from filing a provisional after presentation.

During a presentation, any current/existing patent status informaation is noted and provided to every sponsor, so they are aware if already in process. I can give example of one sponsor where we did a comparative in due diligence as we looked at the filed IP on  submission versus what IP they had already filed as well, and the concepts were different from an IP perspective...but too similar in product direction/mechanics for them to advance with the external idea versus what they already developed and believed in internally.

We heard back from the Worthington team and they opted not to pursue the items in this search.

Their note:

Unfortunately, none of the ideas passed our internal metrics and we will not be pursuing. I will continue to work with you in the future as I thought the process was well managed.

This was a very specific search, but the takeaway is that Worthington Industries, as a brand supports our efforts and the efforts of our innovators - we encourage you to review their site for other product ideas and know that we always keep them in consideration for ideas in the Open Search (you can make a notation in your submission as well!).
